The BYU Honor Code, which all students and faculty voluntarily commit to, outlines specific standards of conduct related to honor, integrity, morality, and consideration of others. Key aspects relevant to NIL include abstaining from alcohol, tobacco, tea, coffee, vaping, marijuana, and other substance abuse, as well as living a chaste and virtuous life, which includes abstaining from same-sex romantic behavior. Additionally, the Honor Code emphasizes respect for others and the avoidance of profane and vulgar language.
BYU's approach to NIL acknowledges these commitments. While student-athletes are permitted to profit from their NIL, they are prohibited from entering into agreements with companies, businesses, causes, or products that do not conform to the BYU Honor Code standards. Examples of such prohibited areas include, but are not limited to, alcohol, tobacco, gambling, and adult entertainment. This restriction ensures that NIL activities align with the university's values and the principles of the sponsoring church.
Furthermore, BYU Athletics has instituted policies requiring student-athletes to have all NIL agreements reviewed by the athletics administration prior to engaging in the activity. This process helps ensure compliance with both NCAA regulations and the BYU Honor Code. The university's Built4Life program also serves as a resource for educating student-athletes and business partners on compliant NIL integration, providing guidance on financial literacy, tax law, and contract law.
This careful approach reflects BYU's commitment to allowing its student-athletes to benefit from NIL opportunities while upholding the values and standards of the university and its sponsoring church. It requires a balance between the evolving landscape of college athletics and the deeply held principles of the LDS faith. While this framework presents unique considerations for BYU athletes and potential NIL partners, it aims to create a structure where both NIL earning potential and adherence to the Honor Code can coexist.
